Public Benefits Law
Public Assistance, Food Stamps, Medicaid and Unemployment Insurance Benefits—many families in New York depend on these benefits to survive. At Legal Services of the Hudson Valley (LSHV), we strive to ensure that New Yorkers receive the public benefits they are entitled to.
Legal representation :: LSHV assists qualified low-income people in obtaining and maintaining appropriate public benefits including public assistance, food stamps and Medicaid. We represent these recipients in fair hearings when they are denied or threatened with termination of these benefits.
Unemployment :: When clients, through no fault of their own, lose their jobs, LSHV helps them obtain unemployment benefits (UIB). UIB, however, is routinely denied. When it appears that the denial is not legitimate, LSHV will represent the individual at an administrative hearing to challenge the denial of unemployment benefits. LSHV believes that it is important for individuals to be represented at these hearings as employers are often represented by high-powered private attorneys. LSHV works to ensure that our client has the same access to high quality legal services.
Workfare :: A requirement of receiving public assistance is maintaining a part-time job or participating in a substance abuse or treatment program. Both of these requirements are intended to foster self-sufficiency. LSHV will also advocate for the approval of an educational program to fulfill these requirements. Further, we advocate for appropriate, individual “Workfare” job assignments as well as safe, affordable childcare for parents who must leave their children in order to participate in the program.
Medical Benefits :: LSHV seeks to ensure that the low income community has access to appropriate health services. We advocate for appropriate medical coverage such as Medicaid and Family Health Plus.
