Health Advocacy
Legal Services of the Hudson Valley addresses the civil legal problems faced by cancer patients that affect their quality of life and their ability to focus on recovery. Our Health Advocacy program provides legal services to ensure that our clients receive necessary medical treatments, as well as legal assistance with government benefits, permanency planning, guardianship, child support and custody, debt relief and bankruptcy, housing, and employment and other rights under the Family Medical Leave Act, Americans with Disabilities Act, and New York State Human Rights laws.
Our experienced and dedicated staff provides the comprehensive and high quality legal services that cancer patients and their families need. Services are provided throughout our service area. This project is funded by a grant from the New York State Department of Health, and we are working in collaboration with Cancer Support Team.
Government Benefits:: Our Health Advocacy program attorneys represent cancer patients and their families who are seeking to access government benefits including Medicaid, Social Security, and public assistance.
Access to Necessary Medical Treatments:: We represent cancer patients when Medicare or private insurance companies deny them necessary medical services.
Advanced Directives:: We provide legal advice on advanced directives, and draft and execute health care proxies, living wills, and wills for cancer patients.
Guardianship and Family Court Issues:: Our attorneys provide advice and file petitions for standby guardianship and represent clients in guardianship cases. In family court matters, we fight for custody of children and for increases in child support.
Housing:: We provide legal representation to clients in matters concerning housing, including housing safety, housing subsidies, and eviction prevention.
Debt Relief and Bankruptcy:: We represent clients in obtaining debt relief and filing for bankruptcy, when appropriate.
Fighting Discrimination:: We provide advice and legal representation to clients to protect their rights under the Family Medical Leave Act (FMLA), Americans with Disabilities Act (ADA), and the New York State Human Rights laws.
